This website is operated by NOVIQEL Holdings Inc., doing business as NOVIQEL. Throughout these Terms, “we,” “us” and “our” refer to NOVIQEL.

By visiting this website or purchasing from us, you agree to these Terms of Service and the policies linked on this store. If you do not agree, you should not use the website or place an order.

Eligibility and customer information

You must be legally capable of entering into a contract in your jurisdiction. You agree to provide current, complete and accurate information when placing an order. You may not use the website or our products for unlawful or fraudulent purposes.

Products, colours and availability

We work to display product descriptions, colours, materials, measurements and images accurately. Lighting and screen settings can affect how colours appear. Fit guidance and measurements are estimates unless otherwise stated.

Products, sizes, colours and quantities may change or sell out without notice. Items sold online must correspond with their product descriptions, subject to applicable consumer law.

Prices and payment

Base prices are shown in Canadian dollars unless the storefront or checkout displays another currency. Applicable taxes, shipping charges, duties and other fees are shown at checkout when available.

Prices may change before an order is placed. We may correct obvious pricing or content errors and contact you before fulfilment. Orders are subject to successful payment authorization.

Orders

An order confirmation acknowledges that we received your order; it does not guarantee acceptance or fulfilment.

We may limit, refuse or cancel an order because of inventory errors, payment failure, suspected fraud, incorrect information or other reasonable concerns. If we cancel an order that has already been paid, the applicable amount will be refunded.

Shipping, returns and refunds

Our Shipping Policy and Return & Refund Policy form part of these Terms. Delivery dates are estimates and can be affected by carriers, customs, weather or circumstances outside our reasonable control.

Nothing in these Terms limits return, refund, warranty or other consumer rights that cannot legally be excluded.

Acceptable use

You must not misuse the website, interfere with its operation, transmit harmful code, attempt unauthorized access, commit fraud or violate another person’s intellectual-property or legal rights.

Intellectual property

NOVIQEL branding, logos, graphics, product photography, text and website content are owned by or licensed to NOVIQEL. They may not be copied, republished, modified or used commercially without written permission.

Third-party services and links

The store may use services provided by Shopify, payment processors, carriers and other third parties. Their services and websites may be governed by separate terms and privacy practices. We are not responsible for third-party websites that we do not control.

Privacy

Personal information is handled according to our Privacy Policy and applicable privacy laws.

Disclaimer and limitation of liability

To the extent permitted by law, the website and its content are provided without warranties beyond those that cannot legally be excluded.

NOVIQEL is not responsible for indirect or consequential loss arising from use of the website or products, except where liability cannot legally be limited. Nothing in these Terms excludes mandatory warranties, consumer protections or remedies.

Severability

If any part of these Terms is found invalid or unenforceable, the remaining sections will continue to apply.

Governing law

These Terms are governed by the laws of Saskatchewan and the applicable federal laws of Canada, without limiting mandatory consumer protections available in the customer’s jurisdiction.
